The New Politics of Background Checks: How legislation, social policy, and the courts are changing the way you screen.

This session examines the controversial social policies, rapid-fire legislation, and influx of law suits that are changing the way employee background checks are done. Employers are experiencing a barrage of new legal requirements and a corresponding uptick in legal claims.  Social policy initiatives like the E-RACE, Ban the Box, and the Equal Employment for All Act are changing the way organizations operate.

In this presidential election year, a recurring theme is the unstable economy’s impact on hiring. The unemployed are fighting back and taking aim at the pre-employment background screening process.  Organizations are being caught in the crosshairs of legal battles over failure to hire and systemic discrimination suits, the Fair Credit Reporting Act, the use of credit, and the use of criminal records.

This session will leave attendees with an in-depth understanding of the new background screening rules and initiatives while engaging in a conversation about the politics and social policies that are driving them.  An advanced understanding of these issues will keep your organization out of court and out of the headlines.
