Other Limitations on Screening for Employers

Employers may not obtain records of arrest, charges and sentences for crimes relating to first offenders in cases where offenders have been exonerated and discharged without court adjudications of guilt except as specifically authorized under Georgia law. With the exception of certain sex offenses a discharge pursuant to Georgia’s First Offender’s Act is not a conviction and may not be used to disqualify an applicant.

State Court Structure

  • Trial Courts: State courts exercise limited jurisdiction within one county and hear misdemeanor cases including traffic violations, issue search and arrest warrants, hold preliminary hearings in criminal cases and try civil matters not reserved exclusively for the superior courts. The superior court exercises both civil and criminal jurisdiction over all felony trials.
  • Appellate Courts: The Court of Appeals is the court of first review for civil and criminal cases heard in the trial courts. The court reviews potential legal errors made at the trial level.
  • Supreme Court of Georgia: The Supreme Court is the state’s highest court and reviews decisions made in civil and criminal cases by a trial court judge or by the Court of Appeals. This court also rules on questions involving the constitutionality of state statutes and all criminal cases involving a sentence of death.

  • United States District Court for the Middle District of Georgia
  • United States District Court for the Southern District of Georgia

Appellate Court:

  • Federal cases in Georgia are appealed to the United States Court of Appeals for the Eleventh Circuit

  • Georgia does not have a statewide ban the box law.
  • City and County Ban the Box: Atlanta and Fulton and Macon-Bibb counties.

Credit Reports

Georgia does not have a law that restricts the use of credit reports in the hiring process.
